Before April 2024, a veteran released from service with a dishonorable charge was not entitled to Veterans Affairs benefits for service-related injuries. This also extended to other benefits, such as education and other vital services. It is important to know that a dishonorable discharge is the most severe type of discharge.
However, a dishonorably discharged veteran can make an appeal for their status to change via a VA review, having circumstantial evaluations performed as to why exactly they were dishonorably discharged. This process is known as a Character of Discharge determination.
The Department of Veterans Affairs Passes a Final Rule for Compensation Modification for Character of Discharge
A VA press release posted on April 2024, stated that the organization has passed an amending rule to its policies for dishonorably discharged veterans. The PR stated that the new rules would make headway for such veterans, giving them the opportunity to seek the benefits they deserve, if proven.
However, the latest regulation is only implemented for providing compensation to specific veterans. The VA will do this by developing a special exception evaluation for specific service members. This will also include service members who have been found guilty of repeat offenses of misconduct.
In addition to that, the new policy will also provide previously denied veterans the chance to apply for their disability compensation again.
